In Canberra, unapproved structures are common but must be addressed, as properties must comply with legal requirements under the crown lease. Here’s what you need to know about unapproved structures, documentation, and the approval process.

Common Structures Requiring Approval

Some of the most frequently unapproved structures include:

  • Decks
  • Pergolas
  • Garages or Carports
  • Fireplaces
  • Roof cladding conversions
  • Internal or sub-floor structural alterations
  • Pool fences

Documentation for Approval

If unapproved work is present, you’ll need specific documents to proceed with the approval, including:

  • Detailed plans of the structure or work
  • Certificate of structural sufficiency from a structural engineer
  • Clearances from relevant entities
  • Proof of property ownership
  • Appointment of a certifier and builder

Approval fees vary depending on the structure and necessary documentation. Working with a building certifier early on is key to ensure that all assessments and required processes are completed in a timely manner.

Example: Why a Pergola May Need Approval

For instance, a pergola taller than 3m, with a covered area over 25m², or with spans exceeding 4m without support, typically requires Building Approval (BA) due to its height, size, and construction. Approval for such structures usually takes 4–6 weeks, excluding any additional rectification work.

Exemption from Approval

Some structures may be exempt from approval, but all exemption criteria must be met. Even if a structure is exempt, it’s advisable to submit an exemption notice package (including plans and supporting documents) to the ACT Government’s Planning section for formal confirmation.
